Morrisville investigates police department





Something isn't right in the Morrisville Police Department but, so far, no one is saying what or why.Following an independent audit, which noted discrepancies within the department, and a recommendation from the borough's insurance carrier to conduct an investigation, Morrisville has been handed a 3,200-page report detailing a decade's worth of police department activities.Morrisville's solicitor and its insurance company have seen the report, which was compiled by Newtown Township's Cornerstone Consulting Services. Copies have also been sent to Bucks County District Attorney David Heckler and state Attorney General Kathleen Kane.
And while Heckler said the portion of the report he has seen so far does not appear to discuss activities that would be criminal in nature, Morrisville has hired a special attorney to review the document and make some recommendations that could range from taking no action to firing police personnel, officials said.
The police department is running without a lead administrator, since former Chief Jack Jones retired in December. Lt. Thomas Herron is running the department of nine full-time and four part-time officers in the meantime.
The newspaper was unsuccessful in reaching Herron or borough Mayor Rita Ledger for comment.
The unnamed special attorney is expected to have results in less than three months. The borough will then act accordingly, officials said.
Additionally, if criminal activity is found, the special attorney would take the findings to the Bucks County District Attorney’s Office, said Nancy Sherlock, the borough council president.
Cornerstone Consulting Services, an investigative company, took about a year to conclude its findings. That report was turned over to the borough in late April, then was passed on to the borough’s solicitor and insurance company, Sherlock said.
The borough’s upper management has remained tight-lipped about the investigation’s details. Sherlock said that none of the council members, including her, knows what’s in those pages because they want to remain impartial.
“My personal opinion, if it has criminal activity, I don’t want to even see it. I don’t want to be biased. I don’t want to know anything. Send it to the proper authorities. There’s no reason it has be hanging around our office, especially if we have to release employees, fire people over all this,” Sherlock said, adding that the council decided to send the report to the proper authorities.
The administration is not releasing the report to the public at this time because of the possibility of legal action.
And if there is criminal activity, the council wants the proper authorities to handle it, she said.
The state Attorney General's Office had little to say about the report.
“It is our policy neither to confirm nor deny investigations,” said Dennis Fisher, a spokesman.
Heckler said his office has been receiving the investigation report piecemeal, and he hasn’t received the entire 3,200 pages. Much of it is internal disputes that could be handled by borough management, Heckler said without going into much detail.
Sherlock said that a 40-pound box was sent to each office with all the findings.
Heckler and borough management have been in contact. But as of last week, the DA’s Office had not responded to Morrisville officially.
“We are waiting to hear from the proper authorities,” Sherlock said.
There were a series of events the led the Morrisville administration to investigate the police department.
Police personnel are suing each other, so the borough’s insurance company advised the administration to conduct an independent investigation, borough Manager Tom Bates said.
In addition, the local government conducted an independent audit — Morrisville had not gone through one in nearly 20 years — that showed discrepancies within the police department.
Morrisville's administration would not release details of those discrepancies either.
The Cornerstone report cost taxpayers $130,000, the audit another $20,000, and the special attorney is costing the borough $350 an hour. The police department’s budget is $1.7 million.

Former Chief Jones has been working at the High School since his retirement, if he has any part of this scandel he should leave that job. What a disfunctional government in this town. Mr. Bates is NOT a borough employee. He is a paid consultant through his company. Yet the borough pays for his education, community group memberships and his vacation. Why have we paid almost $200,000.00 for a report that no one on the council has seen? Yet, they have forwarded it to the solicitor, a special attorney hired to review the report (the review will be done in 2-3 months) at a cost of $350.00 per hour, the District Attorney and the Attorney General of the state! We continue to pay out without a clue what we are paying for.
They were advertising for an interim police director of operations. Whatever happened to that? Now, we see they are advertising for a police chief. Using an outside company that no one has heard of from Newtown. AND they are paying the Chief from Lower Makefield to consult for six months! Where is all this money coming from and who has authorized it to be spent?
Finally, the police officers are being approached by several council members which has caused division and miss trust within the police department. Lawsuits have been filed all because of council interference and a total lack of direction.
Yet, when they get the report that consultant Bates has purchased, no one wants to see it!

What concerns the officers and citizens of this borough is the fact that there are threats, intimidation, unauthorized entry into restricted areas of the police department, missing money from the evidence area and officers that are afraid to do their jobs. All the while, the council announces that they spent hundreds of thousands of dollars and refuse to look at what they purchased. Because they want to remain impartial. They can't be impartial, they are elected officials responsible TO the citizens of our borough. And when someone does request information, the consultant (a non-borough employee) tells them they have to file a right to know. Even if they are an elected official entitled to the information. We guess they are relying on the public continuing to be ignorant.

Our Mayor had to file suit to get a key and a place to conduct business in our borough hall. You noticed that the council made a big stink in the press about it. Yet, the Mayor quietly pursued her rightful place. The council was speechless when they were advised of the law. They gave our Mayor a place to conduct borough business and a key to the police department which is in accordance with a January 2013 court ruling in PA. Where was our solicitor to save us all this needless waste of money. Unless of course he was reaping the payout from council for legal fees. All he needed to do is some on line research and he would have the PA Court ruling in a case in Macunigie that confirmed the Mayor's right.

Officers have gone to the Mayor with concerns. She has acted on our behalf. Instead of pretending that problems don't exist, she has contacted the appropriate county authorities to investigate. Imagine what she could have corrected had she been allowed to know what was going on earlier?
The real questions are why was she prevented from doing her job, who prevented it and what were they hiding? There are good officers in our borough. They just need to know that when they discovered wrong doing, someone is going to do something about it.

She can't do it alone.

I am very close with several of the police officers in Morrisville. What "Uncle Sam" says is the truth. This has been going on for some time. It has gotten a lot worse since Chief Jones was hired. A lot worse!
Only certain officers were interviewed during the $130,000.00 investigation. These officers received paid days off for their testimony. Key officers that should have been interviewed (not involved in the lawsuits) were not.
I agree name calling and family members should be left out of this discussion. Information that the public needs should be offered. We all need to get involved. The first key question to be answered is who on the council barred the Mayor from learning about the problems within our department and why?

I haven't read any of this in a while. When I stopped by today and read this thread I was somewhat surprised.

I'm really trying to understand the train of thought that problems in the police department just don't matter, that we should turn our heads the other way.

It seems like the suggestion is that everything should just be swept under the rug and allowed to continue instead of looking into things.

I am all for this investigation. Sure it costs money, but what is the cost of allowing a police department to continue down a path that would surely end up costing all of us far more than the cost of the investigation.

It seems like there's a lot of campaigning on this thread that has little to do with the investigation.

This town needs to make some serious decisions on whether they are willing to go back to the days when nobody knew what was going on because everything was swept under the rug or continue to move forward. In moving forward, don't point your finger at the participants who are trying to clean up but at the people who promoted bad behavior for so many years.

I understand that there are hometown employees involved, but that doesn't give any of us the right to allow bad behavior to continue.

Theft of taxpayer money in any way is not okay.

(Temporary) Director of Police Operations

Mr. Bates was charged with the task of hiring someone but council wanted to be kept in the loop.

I watched the special meeting of council about hiring the temp chief. Mr. Bates had found someone but council had no knowledge of the person prior to the meeting. It was desired by Council President, Mrs. Sherlock & Borough Manager, Mr. Bates that this person be hired that night. Mr. Rivella was outspoken about wanting more information and wanting the job to be advertised before anyone was hired. It was voted on and the vote failed 7-1, with Mrs. Sherlock being the only person voting for it. It's my understanding that after this meeting, the position was advertised.

If you saw the special meeting, to hire a director for the police department, you would know that Mr. Kerner made the motion to hire him amd Mr. Johnson second the motion. Mrs. Dreisbach and Mrs. Smith made. Motion to table their motion. A vote was taken and a vote to table passed with 6 members voting yes and Mrs. Sherlock voting no. This motion was never taken off the table, yet Mr. Bates decided to ignore this action at a special meeting, and hired an Interum Director of the Police Department. This person started this morning. There was no information given to officials on this matter. This was done solely by Mr Bates. This person must have a contract? Who drew it up? What is his salary, and where is the money coming from? This whole matter should have been voted on by the Borough Counci. What in the world is going on in this borough. Has everyone gone power hungry? This has to be stopped.

I can agree with most of what is said above.

Surely Nancy Sherlock was in the loop with Mr. Bates during this hire. He did not act without her input. Unfortunately, they both acted without borough council's knowledge it would seem, which is a big no no.

The money for the salary is already in the budget as it's the chief of police salary, no matter who is the chief.

I agree with what was said a couple of of posts above that Tom Bates was charged with the task of finding the new chief, but that council wanted to be in the loop of that process.

It was wrong for council to find out about a chief having been hired after it happened. More so since council said that they wanted to be kept informed of the process.

I was upset about this situation and had to take some time within myself to remember some of the good Tom Bates has done for our community. I am not saying the way the chief was hired was right, I'm just saying I'm not willing to get out my pitchfork & torch over this one bad decision when so much good has been done as well.

Tom Bates has benefited more from his companies contract with our borough then the borough has benefited from association with his company! Check the number of police grievance (all won by the police) that have been filed. All of Mr. Bate's ruling's regarding the grievances have been overturned at a cost of thousands of dollars. Of course, the people who hired his company to consult with the borough have reaped dividends from the arraignments.
Some of you have spoken badly about our Mayor. Yet, when contacted by officers after repeatedly notifying Mr. Bates of wrongdoing, action was taken. We can only imagine what would have been prevented if our Mayor did not have to fight Mr. Bate's to uncover the problems in the police department. These discoveries have lead to the discovery of unauthorized entries into police department administrative areas. These entries put into question the security of evidence stored at the police department. All of this questionable activity occurred while key members of our council through Mr. Bates blocked our Mayor from doing her job.
We do not say that the Mayor is faultless. Nor do we say she is perfect. What we are saying is that if she was permitted to do her job in the first place, a lot of this mess could have been avoided. Now they have created a position with an unclear job description indicating that the public safety director reports to the Mayor AND the council through Mr. Bates. Once again violating the borough code and state law.

In reading this thread, I cannot help but be annoyed with the posts such as the one directly above.

I read this blog for information. I appreciate the exchange of information and conversations that take place in a mature manner.

However, lately I read more and more of someone with a childish attitude who brings nothing to the table. Instead of contributing to a conversation with facts or real information this person leaves negative juvenile zings that have no substance.

I understand that this person has planted him/her self here to bring doubt. I can assume since it is concentrated on the borough side of things and not the school board that it is being done by either someone running for council or by "Kitty" running for the mayor seat or one of their supporters.

It doesn't have the desired effect here because generally this blog is made up of a group of people who prefer reasoned discussion. It's annoying, childish and only serves to show the world how small (minded) Morrisville really is.

Go to borough hall and review Mr. Bate's contract. It specifically states that he is NOT the borough manager. If he is NOT the borough manager, how can he be hiring people and signing contracts. Learn the law, review the facts....then feel free to attack.

I have been a volunteer firefighter in this borough for more than 20 years. How does a part time consultant receive vacation pay, life insurance, and all his community groups, organizations and fees for attending luncheons paid by the taxpayer. Plus, he gets to hire his friends with little to know questions?

While the fire service struggles, business as usual continues in this borough. At the expense of those that truly volunteer for a better community.

Bob if you know, how does the paid part time consultant hire someone to give leadership to the police department if no one in the borough has read the report that cost us over $130,000.00?

I did confirm Bob's information with an elected councilperson. We have no borough manager. We have a part time consultant.

I agree we should all work together.
But first we need to know exactly what the problems are, how they were created and who is responsible. Then we put policies and procedures in place that prevent the problems from happening again. We also put a check and balance system in place that prevents unauthorized or misguided spending. The fire department may not be perfect, but we would be out of business if we conducted ourselves the way the borough does.

It is my understanding that the Director was hired by Mr. bates yesterday, nd thn Mr Bates went on vacation until the end of next week??? I have seen in the paper that the Mayor finally received keys to the police station, but I have also heard that the new Director had the locks changed, today! Who requested this?. I do believe they are once again violating the law by locking the Mayor out again! If the Mayor can not do her job and Mr Bates is on vacation, who is instructing this new director of police????

I can make up several fake names and post away as well. I doubt that the people calling themselves firefighters on here are actually firefighters. I also doubt that if I went to the borough and filled out a right to know form to see the right to know book that anyone from the fire company would be listed in it.

Comparing Mr. Bates compensation to that of someone from the fire company is like comparing apples and oranges. It would at least be a somewhat more realistic argument (although still not comparative) to compare the chief of police salary or officer's salaries with that of the fire company. But that wasn't the intent of the posts. The intent is to bring doubt on Mr. Bates and council.

The point we are making and you continue to miss is that the fire company utilizes its funds properly to provide the highest possible protection to the community as possible. We also follow policies and procedures put in place as a check and balance system to assure the highest quality of service. If we paid $130,000.00 for a study, you can bet we would READ IT! Before sending it anywhere else!

I believe the Cornerstone investigation will be a lot more than $130,000. Keep in mind that the solicitor's tab is still running. And I'm sure it will be a nice price tag for the $350 an hour special attorney. I'm guessing over $200,000 price tag probably.

I am a huge supporter of the fire company, although I agree that whomever is posting here as a firefighter is not actually with the fire company. It is very bad taste.

If you are told to perform an investigation by the insurance company and you don't, how much could that potentially cost? Millions? The cost of not following the insurance company's guidelines and the cost of keeping a corrupt police department is far more than the cost of an investigation. Yes the investigation has a price tag. Everything does.

How anyone can possibly be okay with having a police department that is stealing taxpayer's money is beyond me.

I commend the borough for moving forward with this. If you know the police department is behaving badly, you just cannot sit back and pretend you don't know.

For anyone blogging with an agenda this is your golden goose. If the borough didn't have the investigation you would bash them for it. The borough has an investigation and you get to bash them for that as well.

However, if you paid for the investigation why would you not read it before sending it somewhere? who told the Council President that there was criminal activity in there? why has our district attorney stated that he has not seen anything criminal in the parts that were sent to him. It makes NO SENSE to pay for something and not read it. How can you comply with the reports suggestions if you didn't read it? If there is criminal activity IMMEDIATE action is required! If they are "behaving badly" immediate action is required. You can't have it both ways. Pay thousands for a report and refuse to read it. How many of the council members have read it? Why are they not asking to see it? Why are we kept in the dark. And most important, the lack of transparency makes the good officers look bad through association. That is a disservice to the fine officers that protect us.

I am sooooo tired of reading this conversation that I finally asked someone at the borough who would know. Council was told by the borough solicitor that they are not allowed to view the Cornerstone report. The report has been turned over to the proper authorities. In this case that means higher up than Morrisville. Like it or not. Everything is being done as it should.

There is a few very good and sincere Police and Officials here in Morrisville, some great parents and teachers. And so on. BUT, there are also a few seriously twisted and corrupt Officers who should not have the privilege of wearing a Law Enforcement uniform and certainly never, ever allowed access to any type of firearm.
A law abiding, hardworking, citizen who has been defending himself against Bill "Psycho" Smith and his side-kick "Ricochet" Smeltzer, for over a decade was in Morrisville Court. A file of tickets mailed without look-up. PennDot records defying claims against the Cop’s accusations but the nightmare won’t stop. I watched in horror, holding back tears of disbelief as a young man was accused of another, unproved, traffic violation; adding to a stack of over 12 Warrants - written by the same 2 cops.
On top of it all, the full-time employed, manager with his own office, IT guy, carpenter and electrician’s apprentice, who started his own business at age 11, cannot catch a break. In fact, when one hopes for Justice, one instead gets this Sicko District Court Judge. A Whack-Job who actually vacillated between complimenting the young man’s appearance to prodding him, demanding an answer as to "when was the last time” the young man had gotten LAID…from threatened to cuff him and ship him off to jail, to “giving (him) a Gift, while insulting his life, claiming to “know(him) better than anyone else”.
The pathetic cowards hide under their desks, the bullies get away with decades of abuse, the Righteous who try to act accordingly get locked out, discriminated, insulted, harassed, slandered, threatened, charged, incarcerated…or, if they are REALLY LUCKY, chased out of Dodge.
I made the mistake of voting for Mayor Rivella. He’s Spineless. The new Chief is nothing better than a Philly Bully. I made the Grant Mistake of actually thinking “If I just stay the course, my good deeds will rise above the Slanderous Trash and their Gossiping Pre-occupations” FAT CHANCE IN MORRISVILLE.
